Comprehensive Standard 3.2.14 - Policies governing intellectual property
The institution's policies are clear concerning ownership of materials, compensations, copyright issues, and the use of revenue derived from the creation and production of all intellectual property. This applies to students, faculty, and staff.
Judgment
of Compliance
Davidson College is in compliance with Comprehensive Standard 3.2.14.
Rationale
for Judgment of Compliance
Two policies effectively address copyright and intellectual property issues at Davidson College. “Davidson College Inventions and Patent Policy,” is summarized in its introduction:
Davidson College is dedicated to teaching and to the pursuit of knowledge. While the primary focus of these activities is to lead students to lives of leadership and service, the College recognizes that inventions and discoveries of commercial importance may be a natural outgrowth of activities within the College community. The following policy statement clarifies the ownership rights to inventions made by employees and students of Davidson College.
The goal of the inventions and patent policy is to ensure that discoveries, inventions, and other creations generated by faculty, staff, and students of Davidson College are utilized in ways most likely to benefit the public. The College seeks to assist its faculty and other researchers in properly disclosing their scholarly work, in complying with applicable laws and formal agreements, and in gaining the protection available under United States laws governing patents. Likewise, the College seeks to ensure that commercial benefits are distributed in a fair and equitable manner that recognizes both the contributions of the inventors and the interests of Davidson College.
Davidson College is also in compliance with the Digital Millennium Copyright Act of 1998 (the DMCA). The following policies and procedures have been adopted to ensure that Davidson College remains in compliance with the DMCA:
We will promptly investigate any complaints properly made pursuant to the DMCA by copyright owners regarding allegedly infringing activity by any student, faculty member or staff member of Davidson College.
We will notify the allegedly infringing user of the complaint by forwarding the complaint to the user and discussing the matter in person with the user. We will inform the user that such allegations, if true, constitute a violation of United States copyright laws.
If we believe that the activity violates any applicable law, we will expeditiously take down or block access to any infringing material and/or require the student, faculty member or staff member to (i) permanently delete any infringing material from his or her computer hard drive and any other place in which such infringing material resides, and (ii) confirm in writing that such deletion has occurred.
In addition, in order for Davidson College to remain in compliance with the DMCA, its faculty or adjunct faculty members may not require, recommend or make available online course materials that infringe on a copyright owner’s interest.
Provisions are also made for handling instances of non-compliance with the DMCA. Davidson’s procedures are available in their entirety here.
